PuzzleLogic, Inc. (“PuzzleLogic”) takes privacy seriously and this policy sets out our privacy practices, explains how we handle the information we collect when you visit and use the PuzzleLogic website, through PuzzleLogic software and services, through PuzzleLogic software modules, through email that PuzzleLogic sends you, and through other means offered and controlled by PuzzleLogic (collectively the “Services”). When you use Services, and/or provide Personal Information to PuzzleLogic through the Services, you agree and are consenting to the collection, transfer, manipulation, storage, disclosure, and other uses of your information as set out in this Privacy Policy. Additionally, your use of certain Services may be governed by separate terms and conditions entered into between PuzzleLogic and your or the organization for which you work.  Those terms and conditions may authorize different practices than those described in this Privacy Policy.  Therefore, please refer to all applicable terms and conditions that govern your use of the Services.  Privacy is important so please read this carefully.

What do we mean by Personal Information?

In this Policy, "Personal Information" means information or an information set that identifies or could be used by or on behalf of PuzzleLogic to identify an individual. Except as described in this Policy, PuzzleLogic will not give, sell, rent or loan any Personal Information to any third party. Examples of Personal Information include:

  • Name
  • Postal address (including billing and shipping addresses, and state/province and zip/postal code)
  • Email address
  • Telephone number
  • Usernames and passwords you create to use the PuzzleLogic Services
  • Credit or debit card number and/or bank routing information you provide for processing of payments

If you submit any Personal Information relating to other people in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy

How Do We Collect, Use and Share Your Personal Information and Other Information?

Information You Provide to Us

We and our service providers may collect Personal Information from you in a variety of ways. You may provide PuzzleLogic with your Personal Information when you create an account on any PuzzleLogic website, register your software, download a software update, register for support, sign up for Services, register for a seminar, send us information for troubleshooting or other analysis, purchase software, participate in a survey or other promotional activities, or solicit communication from PuzzleLogic. We may also receive your Personal Information from other online and offline sources, such as public databases, joint marketing partners, social media platforms, conference hosts, event companies, and other third parties. If you log in to any of our services using your social media login credentials (e.g., Google+), we may receive Personal Information as determined by the privacy settings of the applicable social media platform. You may refuse to supply Personal Information when doing any of the foregoing, with the understanding that this may prevent you from engaging in certain activities or using certain products or services.

How We May Use Personal Information

PuzzleLogic uses Personal Information for various purposes, including to help us deliver the highest possible level of customer service.  For example, we may use Personal Information:

  • To respond to your inquiries and fulfill your requests.
  • To provide you with our products or services, including software updates.
  • To allow you to sign up for and manage an account so that you can, among other things, participate in our online communities or submit and track a support case.
  • To send you administrative information, for example, announcements regarding our products or services, and changes to our terms, conditions, and policies.
  • To complete and fulfill your purchase, for example, to communicate with you and provide you with related customer service.
  • To send you marketing communications that we believe may be of interest to you, including product announcements, educational materials, special offers, and upcoming online and offline events in accordance with your communication preferences.
  • To personalize your experience by focusing on and presenting content, products, and offers tailored to your interests.
  • To allow you to participate in various promotional activities, usability studies, surveys and product tests.
  • For our business purposes, such as performing data analysis and audits, developing new products, improving our services, identifying usage trends, understanding the interests of our users, and determining the effectiveness of our promotional campaigns.
  • As we believe to be necessary or appropriate: (a) under applicable laws, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

How We May Disclose Personal Information. PuzzleLogic may disclose your Personal Information:

  • To our third-party service providers, vendors, and strategic partners who we engage to provide services such as data hosting, data analysis, order fulfillment, delivery of products or services, management and enhancement of user data, infrastructure provision, IT services, customer service, email delivery services, auditing services, and other similar services, to enable such third parties to provide those services.
  • To third parties, including our strategic partners and resellers, to permit them to assess your interest in PuzzleLogic’s products and services, to conduct user research and surveys, or to send you their own marketing communications in accordance with your communication preferences.
  • When you choose to post information or materials on message boards, chats, profile pages, wikis, blogs, and other areas within the Services. Please note that any information you post or disclose through these services may be available to visitors to those services and to the general public. We urge you to be very careful when deciding to disclose your Personal Information, or any other information, on these services.
  • As reasonable to proceed with the negotiation or completion of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

Log Files

As is true with most websites, PuzzleLogic gathers certain information automatically and stores it in log files. This information includes internet protocol addresses as well as browser, internet service provider, referring/exit pages, operating system, date/time stamp, and click stream data. Occasionally, we may connect Personal Information to information gathered in our log files, as necessary to improve the Service for individual customers. Otherwise, we generally use this information as we would any Usage Data, to analyze trends, administer and maintain the Service, or track usage of various features within the Service.

Cookies

A "cookie" is a small software file stored temporarily or placed on your computer's hard drive. The main purpose of a cookie is to allow a web server to identify your computer and web browser, and tailor web pages and/or login information to your preferences. Cookies help us promptly display the information you need to use the capabilities of the Services and other information which we consider to be of interest to you. By gathering and remembering information about your website preferences through cookies, we can provide a better web and marketing experience. Cookies don't give us access to users' computers, and the information we collect through cookies doesn't include Personal Information.

When you use the Services we utilize "session cookies," which allow us to uniquely identify your browser while you are logged in and to process your online transactions. Session cookies disappear from your computer when you close your web browser or turn off your computer. We also utilize "persistent cookies" to identify you as a PuzzleLogic customer, agent or end user and make it easier for you to log into and use the Services. Persistent cookies remain on your computer after you close your web browser or turn off your computer.

We utilize various categories of cookies, which are summarized below along with the options available to you to manage them.

Essential Cookies. Essential cookies are those that are critical to the functionality of the Services. We use these cookies to keep a user logged into the Service and remember relevant information when the user returns to the Service.

Analytics/Performance Cookies.  Analytics Cookies track user behavior on our Services by counting the number of visitors to our Services and tracking how visitors move around our Services.  This helps us improve the Services' content and your experience on our Services. These Cookies include content optimization (A/B testing) Cookies. PuzzleLogic uses analytics (or performance) Cookies to collect information about how you use our Services (e.g., which pages you visit, if you experience any errors) and how you interact with our communications. These Cookies do not collect any information that could identify you - the information collected is only used to help us improve how our Services work, understand what interests users of our Services, and measure the effectiveness of our advertising generally.

If you disable these Cookies, we will not be able to learn how you utilize our Services, and our ability to improve the content and operation of our Service will be impaired.

Functionality/Customization Cookies.  Functionality Cookies are used to provide the services you have requested or to remember your settings in order to improve your visit to our Services. They also allow us to manage and control variations of Services, to understand which pages are most successful, and to provide you with enhanced services, such as allowing you to watch a video on our Services or comment on a blog. PuzzleLogic uses functionality Cookies to collect information regarding your preferences on our Services, including your preferences with respect to region, language, text size, fonts, and any other parts of our Services' appearance that you can customize. If you disable these Cookies, we will not be able to remember your Service preferences and you will have to reset those preferences each time you visit our Services.

Advertising Cookies. Advertising Cookies are used to track the efficiency of our online advertising campaigns and marketing communications, and allow us to deliver advertisements more relevant to you and your interests. These Cookies include ad tracking Cookies. PuzzleLogic uses these Cookies to collect data on the times you have visited our Services and advertisements and interacted with our communications. Web Beacons

We may also employ web beacons (also known as pixel tags and clear GIFs) to help us better manage content in the Services by informing us what content is effective. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of internet users. Unlike cookies, which are stored on a user's computer hard drive, web beacons are embedded invisibly on websites. We tie the information gathered by web beacons to Personal Information we otherwise collect, and use and store certain types of information whenever you interact with our Services and emails in order to improve their performance, distinguish you from other users of our Services, and enhance your user experience when you use our Services.  If you continue to use our Services or open our emails, you consent to the use of web beacons on such Services. You can opt-out of these emails by following the unsubscribe instructions within such email or other materials.

Other Information

In addition to the purposes described above, we disclose Personal Information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our End User License Agreement, other terms and conditions established by PuzzleLogic, or as otherwise required by law.

PuzzleLogic also collects information that does not reveal your specific identity and does not directly relate to an individual (“Other Information”). Please note that we may use and disclose Other Information for any purpose, except where we are required to treat Other Information as Personal Information under applicable law, in which case we will use it for all the purposes for which we use and disclose Personal Information described above. In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we do, we will treat the combined information as Personal Information as long as it is combined. Examples of such Other Information, and PuzzleLogic’s collection, use, and disclosure of same, include:

Aggregated Personal Information. Aggregated Personal Information does not personally identify you or any other user of the Services. We may use and share aggregated Personal Information for any purpose (for example, we may aggregate Personal Information to calculate the percentage of our users who have a particular telephone area code).

Device Information. Certain technical information is collected from the computer, device, or browser that you use to access the Services, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Service you are using. We use this information to ensure that the Services are functioning properly, to determine whether you might benefit from a newer version of PuzzleLogic software, for troubleshooting, to improve our products and services, to analyze trends, and to understand our users.

Usage Data. Personal Information does not include "Usage Data" which we define as encoded or anonymized information or aggregated data we collect about a group or category of services, features or users which does not contain personally identifying information Usage Data helps us understand trends in usage of the Service so that we can better consider new features or otherwise tailor the Services. In addition to collecting and using Usage Data ourselves, we may share Usage Data with third parties, including our customers, partners and service providers, for various purposes, including to help us better understand our customers' needs and improve the Service as well as for advertising and marketing purposes. We do not share Usage Data with third parties in a way that would enable them to identify you personally.

IP Addresses. Your IP address is a number that is assigned to the computer that you use to access the Internet. We automatically log IP addresses in our server log files whenever you use the Services, along with the time of your visit and the page(s) that you visited. PuzzleLogic uses IP addresses to analyze trends, administer the services, track user movement, and gather broad demographic information for aggregate use and to comply with applicable laws.

Physical Location. On mobile devices that enable location-based services, we may collect the physical location of your device (determined by GPS or other signals) through your device’s operating system if you consent to us doing so. We may use this information to provide you with personalized location-based services and content.  You can restrict our access to your device’s location by managing the location-based service preferences on your device.

Links to Other Websites

The Service contains links to other websites and web applications that are not owned or controlled by PuzzleLogic Please be aware that we do not determine and we are not responsible for the privacy practices or content of such other sites. We encourage you to be aware when you leave the PuzzleLogic website and/or Services, and read the terms of service and privacy statements of other websites and web applications linked to the Services. This Policy applies only to information collected by the Services.

Protection of Information

PuzzleLogic is committed to ensuring the security of your Personal Information. We utilize precautions to protect the confidentiality and security of the Personal Information within the Services, by employing technological, physical and administrative security safeguards, such as firewalls and other security procedures. For example, when you enter sensitive information (such as login credentials and all your activity on our Service platform) we encrypt the transmission of that information using secure socket layer technology (SSL). These technologies, procedures and other measures are used in an effort to ensure that your data is safe, secure, and only available to you and to those you authorized to access your data. However, the security of information transmitted through the Internet can never be guaranteed. PuzzleLogic is not responsible for any interception or interruption of any communications through the Internet or for changes to or losses of data. Users of our Services are responsible for maintaining the security of any password, user ID, or other form of authentication involved in obtaining access to password protected or secure areas of any PuzzleLogic Services.  Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications will remain private, so you should take care in deciding what information you send to us in this way.

Choice

If you are an PuzzleLogic customer and would like to opt-out of getting marketing communications from PuzzleLogic please contact us at support@PuzzleLogic.com or follow the unsubscribe instructions included in each marketing email. Please note that if you are a trial or paying customer, you cannot opt out of service and system generated emails.

Correcting and Updating Your Information

Customers may update or change the Personal Information they have provided PuzzleLogic by logging into the Service and providing such additional information where applicable. If you are our customer and would like to gain access to, or request deletion of information we have collected as "data controllers," please contact us at support@PuzzleLogic.com.

Data Retention

PuzzleLogic will retain Personal Information we process on behalf of our customers for as long as needed to provide Services to our customers, subject to our compliance with this Policy. We may further retain and use this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Use of Services by Minors.

The Services are not directed to individuals under the age of thirteen (13) or those not of the age of majority in your jurisdiction, and we request that these individuals do not provide Personal Information through the Services.

Sensitive Information

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religious or other beliefs, health, sexual orientation, criminal background, or trade union membership) to us.

Changes to the Privacy Policy

We may make material changes to this Policy. We encourage you to periodically review this page for the latest information on our privacy practices. If we change our Privacy Policy, we will post an updated privacy policy at [www.puzzlelogic.com/privacy], and it will become effective as of the date of posting. Your continued use of the Service constitutes your agreement to be bound by such changes to this Policy. Your only remedy, if you do not accept the terms of this Policy, is to discontinue use of the Service.

Business Transactions

PuzzleLogic may assign or transfer this Policy, and your user account and related information and data, including any Personal Information, to any person or entity that acquires all or substantially all of the business, stock or assets of, or is merged with Effective Technologies Inc.

Customer Testimonials/Comments/Reviews

From time to time, we post customer testimonials on the PuzzleLogic Websites which may contain Personal Information. We obtain the customers consent to post their names along with their testimonials.

Public Forums

The Service (including the PuzzleLogic Websites) offers publicly-accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your Personal Information from our blog or community forum, contact us at support@PuzzleLogic.com. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.
